When to file a complaint — the most common grounds
The vast majority of bailiffs carry out their duties professionally. But when this is not the case, several concrete situations can justify an investigation request to the Office of the Syndic.
Failure to comply with the rules of the Code of Civil Procedure: documents delivered to the wrong person, no minutes drawn up, non-compliant method of service, sale notice improperly published.
Intimidation, threats, inappropriate remarks, aggressive tone during a seizure or eviction, failure to identify oneself properly, manifest abuse of power.
Billing exceeding the government-regulated tariff, unjustified charges, fees disproportionate to the work actually performed (sec. 32-33 of the Code of ethics).
Failure of diligence causing harm to the client, lack of impartiality, breach of the duty to inform the parties, unauthorized disclosure of personal information.
An investigation request to the Office of the Syndic aims to trigger a disciplinary process to protect the public. The Disciplinary Council cannot award you compensation or set aside a seizure — it can only sanction the bailiff at fault.
To contest the amount of a bailiff's fee invoice, there is a separate procedure: the fee conciliation of the CHJQ. You have 45 days after receiving the account to make the request. This service is free and runs in parallel to a complaint to the syndic.
To contest the legal validity of a seizure or a judicial procedure, the appropriate recourse is to apply to the court that rendered the judgment, not to the syndic. A lawyer can advise you on these recourses.

Send your request to the Office of the Syndic
The Chambre des huissiers offers two official channels to submit an investigation request: email to the Syndic (the fastest channel), or the official PDF form to download, fill out and send by email or by mail with supporting documents.
The service is entirely free. The Syndic will send you an acknowledgment of receipt. The investigation is strictly confidential and the order undertakes to comply with the deadlines set by the Professional Code. Keep your file number — that is what you will need to use in all subsequent communications.
Possible decisions after the syndic's investigation
Once the investigation is complete, the Syndic informs you in writing of their decision:
Decision to file a complaint before the Disciplinary Council · OR decision not to file a complaint (closure of the file)
If the Syndic decides to file a complaint, the Disciplinary Council of the Chambre des huissiers will hear the case. It is composed of three persons: a chair appointed by the Government (a lawyer) and two bailiffs. If the bailiff is found guilty, several sanctions can be imposed: reprimand, temporary or permanent striking off the roll, restriction or suspension of the right to practise, or fine. The bailiff can appeal the decision before the Professions Tribunal.
If the Syndic decides not to file a complaint, you have the right to request the opinion of the Review Committee. Your request must be submitted in writing within 30 days of receiving the decision.
You have 30 days to request a review of a refusal. Do not let this deadline pass.
As a last resort, a citizen can also file a private complaint themselves directly with the Disciplinary Council, without going through the syndic. This procedure is more complex: you then become responsible for preparing the file, presenting the evidence and demonstrating the ethical breaches. It is strongly recommended to consult a lawyer for this option.
