LAWYER MALPRACTICE IN QUEBEC: HOW TO GET COMPENSATED
Claiming compensation from the Fonds d'assurance responsabilité professionnelle du Barreau du Québec (FARPBQ) — Plain-language citizen guide 2026
VERSION FRANÇAISE →Your lawyer made a mistake and you suffered a financial loss. In Quebec, you have the right to seek compensation directly from the FARPBQ. This guide walks you through exactly which situations are covered, what conditions your claim must meet, and how AI can help you build a stronger file.
Too many people abandon their right to compensation after a lawyer's error, assuming the process is too complicated. It is not.
When to claim — the most common situations
A missed limitation period, seriously deficient document drafting, or bad legal advice that caused you measurable, direct financial harm.
Your lawyer held money on your behalf and mishandled it — this falls squarely within the Fund's mandate.
Your lawyer collaborated with or favoured the opposing party in a way that caused you direct, quantifiable financial damage.
Reimbursement of the lawyer's professional fees is explicitly excluded under article 2.04 of the insurance policy. The FARPBQ compensates for actual damages caused by the error — not for what you paid the lawyer.
For a claim to be admissible, three elements must all be present simultaneously:
How to claim — 3 steps
Download the official 2026 forms and gather your evidence
Do this before opening any AI tool. The FARPBQ requires that you download the form, complete it on screen if possible, print it, sign it, and then transmit it. Read the Claimant Guide before filling anything in.
Official 2026 documents:
Then organize your evidence chronologically: all relevant dates, every email and letter exchanged with the lawyer, all invoices and court decisions involved, and any document that quantifies your financial loss in concrete figures.
Complete the official claimant form
Open the Claimant Form (PDF 2026). Read the Claimant Guide first. Fill in every field: your contact information, the lawyer's details, a description of the fault, the damages you suffered, and the amounts you are claiming. Then sign it.
The FARPBQ explicitly states that your completed form and all documents you submit will be forwarded to the lawyer you are claiming against. Write factually. Write precisely. Leave emotion out of it — every word you write will be read by the person you are accusing.
The 2026 form is interactive — you can fill it in directly on screen in your PDF reader before printing. This is the method the FARPBQ recommends.
Use AI to draft your claim email
Open Claude, ChatGPT or Gemini and use this prompt:
Use the AI-generated text to complete the relevant fields in the form: question 2 (why you consulted the lawyer), question 4 (the fault alleged), question 5 (description of damages suffered). Then attach the completed, signed PDF along with all supporting documents.

What happens after you submit
Upon receiving your form, the FARPBQ will open an investigation. Their first step is to verify whether the applicable insurance policy allows them to intervene. They may contact you for additional information during the process.
Filing a claim with the FARPBQ does not suspend any legal limitation periods for bringing a court action. In professional liability matters, the general limitation period is 3 years from the date you discovered the fault. The FARPBQ will not advise you on these deadlines. Consult a lawyer of your choice on this question, at your own expense — and do it early.
Once the investigation concludes, the FARPBQ will communicate its position to you. That position is final — there is no internal review or appeal process. If liability is accepted, the Fund may offer you a compensation amount. If no agreement is reached, it is your responsibility to pursue the matter before the courts within the applicable limitation periods.
The FARPBQ is not on your side
The FARPBQ is not a public advocacy service for citizens. It is the insurance company for the lawyer you are claiming against. Its institutional role is to protect its insured and to minimize payouts. You are in an adversarial relationship from the moment you file.
Submit facts and figures, not frustration. The form you send will land on your lawyer's desk. Make every sentence count — and keep emotion entirely out of it.

Build a factual file, respect the deadlines, and remember that a FARPBQ claim and a disciplinary complaint to the Bureau du syndic are not mutually exclusive — they are complementary tools that can be pursued simultaneously. One seeks to compensate you. The other seeks to protect the public. You can and should do both.
