Feeling betrayed, stonewalled or taken advantage of by your lawyer? You are not alone — and you have options. The Bureau du syndic of the Barreau du Québec is the independent body responsible for investigating misconduct by members of the Bar. It exists to protect the public — and it is up to you to put the facts before it.

When does a complaint make sense?

Most lawyers provide competent, professional service. But when they don't, several types of situations can justify a formal investigation request.

Abandonment and silence are among the most common grounds: your lawyer has stopped responding, you are hearing critical news from the opposing party instead of your own counsel, or you simply cannot reach them anymore.

Serious errors and incompetence represent another category: a missed deadline, poorly drafted documents, or a legal strategy that is plainly unsuited to your situation can constitute a breach of the professional duty of competence.

Billing problems are also frequently reported: opaque or excessive fees, mishandling of funds held in trust, or a refusal to return money that belongs to you. Worth noting: for disputes specifically about fees, the Barreau offers a free conciliation service — but you must request it within 45 days of receiving the final invoice.

Conflicts of interest round out the most common grounds: if your lawyer appears to be advancing interests that conflict with yours, or has a relationship with the opposing party that undermines your defence, that warrants investigation.

One important distinction: a complaint to the Bureau du syndic triggers a disciplinary process aimed at protecting the public — it is not the right avenue if your primary goal is financial compensation. For that, you need to turn to the Fonds d'assurance responsabilité professionnelle du Barreau du Québec.

How to File Your Complaint: A 3-Step AI Guide

Step 1 — Organize Your Facts Before Anything Else

Don't open an AI tool yet. Start with a blank document and write a straightforward chronological summary of what happened. Keep it factual, keep it concise.

Four things must be in that summary: the lawyer's full name and professional address; the key dates of each incident; a concrete description of what they did or failed to do ("did not respond to 8 emails between [date] and [date]," "missed the filing deadline of..."); and a list of the evidence you have — emails, invoices, letters, call logs, screenshots.

Getting this right before involving AI will produce a significantly better result at the next step.

Step 2 — Let AI Draft Your Investigation Request

Open any AI assistant — Claude, ChatGPT or Gemini — paste your factual summary, and use the following prompt:

"I want to draft a formal investigation request addressed to the Bureau du syndic of the Barreau du Québec against the lawyer [Full name, professional address]. Here are the facts: [paste your chronological summary]. Write a factual and professional investigation request. Identify which articles of the Code of ethics of advocates appear to have been violated based on these facts — for example, the duty to act with competence, the duty to communicate, or the duty to avoid conflicts of interest. The document should be clear, respectful and ready to send."

Step 3 — Submit to the Bureau du syndic

You will receive an acknowledgment of receipt with your file number within ten business days. Keep that number — it is the reference you will use in every future communication about your case.


If the Syndic Decides Not to File a Disciplinary Complaint

The investigation does not always result in formal charges. If the Bureau du syndic concludes that no disciplinary complaint is warranted, you have the right to request a review of that decision before the Comité de révision du Barreau du Québec. You have 30 days from receipt of the decision to make that request. Do not let that deadline pass.
